BJ Finneran has been a civil litigator for over 30 years, litigating complex commercial disputes in the state and federal court systems. BJ represents multinational financial institutions, banks, and Fortune 500 companies, with a specialty in the areas of commercial litigation, real estate litigation and banking law. BJ effectively represents lenders and special servicers in connection with non-performing portfolio and commercial CMBS loans involving workouts, receiverships, class actions and judicial and non-judicial foreclosures. BJ also represents real estate clients in actions involving breach of contract, breach of fiduciary duty, fraud, and business torts. BJ employs his extensive litigation experience in crafting innovative litigation strategies that result in successful outcomes in any court or matter. His skills, combined with ZEK’s aggressive litigation strategy, enable ZEK’s clients to prevail in complex commercial matters, often early in the litigation process. He also advises mortgage seekers and financial institutions on contested residential foreclosure, creditor's rights, bankruptcy and morgagor-initiated litigation. Most recently BJ successfully established a bank's standing to foreclose at trial, utilizing a lost note affidavit and records from a prior loan service. BJ is a trial lawyer. He utilizes his extensive courtroom and trial experience as an Assistant District Attorney and commercial trial attorney in successfully representing ZEK clients at trial, in evidentiary hearings involving multiple fact and expert witnesses, in arbitrations, in mediations, and in settlement conferences. BJ successfully represented a multi-national bank in connection with an action challenging lender loan practices that could have far reaching ramifications and application to countless other loans and litigated matters. BJ joined ZEK’s New York office in 2008.
