In the article, Garrie and Griver explain that rating agencies (e.g., Moody’s, Standard & Poor’s, Fitch Ratings) have begun waking up to the reality that one new and increasingly important factor that can dramatically impact a company’s value is cyber risk. Depending on the company, cyber risk represents a very real risk vector that should be incorporated into the ratings issued by the rating agencies. Companies (and their attorneys) need to make sure that cybersecurity policies, practice, education and technologies all work in tandem, or risk having their ratings downgraded, leading to increased cost and difficulty in borrowing and/or attracting and keeping investors.
